USCIS Reaches FY 2027 H-1B Visa Cap After Receiving Required Number of Petitions
What Is the H-1B Visa Program?
The H-1B visa is one of the most popular temporary work visa programs in the United States. It enables U.S. employers to hire foreign professionals in specialty occupations that require highly specialized knowledge and at least a bachelor’s degree or its equivalent.

FY 2027 H-1B Cap Has Been Reached
USCIS confirmed that it has received a sufficient number of petitions to fill both categories of H-1B visas available under the annual cap.

Once these limits are reached, USCIS stops accepting new cap-subject petitions for that fiscal year, except in cases that qualify for statutory exemptions.
Why Is There an Annual H-1B Cap?
The visa allocation consists of:
- 65,000 visas under the regular annual cap.
- 20,000 additional visas reserved for applicants who have earned a master's degree or higher from an accredited U.S. institution.
Demand for H-1B visas consistently exceeds the available quota, resulting in the use of an electronic registration and selection process before employers can submit petitions.
What Happens Now?
With the FY 2027 cap reached, USCIS will begin processing the cap-subject petitions that were selected during the H-1B registration process. Petitions that were not selected during the registration process cannot be filed under the FY 2027 cap. Employers whose registrations were chosen must continue submitting complete petitions within the filing period specified by USCIS.
Meanwhile, USCIS will continue accepting and processing H-1B petitions that are not subject to the annual cap, including eligible exempt categories.
Who Can Still File H-1B Petitions?
These include petitions for:
- Current H-1B workers requesting extensions of stay.
- Changes to employment terms for existing H-1B employees.
- Transfers to a new employer.
- Concurrent H-1B employment with multiple employers.
- Certain cap-exempt employers, including qualifying higher education institutions, nonprofit research organizations, and governmental research organizations.
These petitions are not counted toward the annual H-1B cap and will continue to be processed according to existing USCIS procedures.
Impact on Employers and Foreign Professionals
The announcement confirms that employers who intended to sponsor new cap-subject H-1B workers for FY 2027 can no longer submit additional petitions unless they fall within an exempt category.
For foreign professionals whose registrations were selected earlier this year, petition processing will continue as scheduled. Those who were not selected will generally need to wait for a future H-1B registration cycle or explore alternative U.S. work visa options if eligible.
Strong Demand Continues for Skilled Workers
The H-1B program remains one of the most competitive employment visa pathways in the United States. Every year, demand from employers across technology, healthcare, engineering, finance, and research sectors significantly exceeds the statutory limit of available visas.
Indian professionals continue to account for the majority of H-1B beneficiaries, reflecting the ongoing demand for highly skilled talent in the U.S. labor market.

Applicants whose H-1B registrations were selected should work closely with their sponsoring employers to ensure all required documentation is submitted correctly and within the designated filing window. Individuals who were not selected under the FY 2027 cap may consider other employment-based immigration pathways, employer-sponsored visa categories, or prepare for the next H-1B registration cycle. USCIS will continue processing eligible petitions submitted under the FY 2027 cap while also accepting cap-exempt H-1B filings throughout the year.
